These Terms of Use govern your access to and use of the Malwise website at malwise.co.uk (operated by Malwise Cyber Ltd, which also operates malwise.uk). By using the site you accept these terms in full. If you do not accept them, you should not use the site.
These Terms cover the website only. Any engagement to deliver services is governed by a separate written agreement signed at the start of the work. Nothing on this site constitutes an offer to enter into such an agreement, and these Terms do not create one.

References to “Malwise”, “we”, “us” and “our” in these Terms mean Malwise Cyber Ltd. References to “you” and “your” mean the person accessing the site.
2. Acceptance and changes
By accessing or using this website, you confirm that you accept these Terms and that you agree to comply with them. We may revise these Terms from time to time. The current version is always the one published on this page, and the “Last updated” date at the top tells you when it was most recently revised. Continued use of the site after a change constitutes acceptance of the revised Terms.
3. Permitted use
You may access the publicly available pages of this site for lawful purposes, including reading, sharing links to public pages, and submitting genuine enquiries through the contact form or email.
You may not use this site, or any content on it:

- in any way that is fraudulent, deceptive, or has any fraudulent or deceptive purpose or effect;

4. Prohibited security activity
Because Malwise is a cyber security consultancy, we anticipate that some visitors may be tempted to test the security of our site or systems. To be clear:
- You may not conduct any form of penetration test, vulnerability scan, automated probing, fuzzing, denial of service test, social engineering attempt, or other security assessment of this site, our infrastructure, or our staff, without our prior written authorisation under a signed engagement.
- “Just looking” does not constitute authorisation. Unauthorised security activity will be treated as an offence under the Computer Misuse Act 1990 and reported to the relevant authorities, regardless of whether any damage is caused or any data is accessed.
- If you believe you have identified a security issue with our site and wish to report it responsibly, please email security@malwise.co.uk with details. We welcome good-faith reports and will not pursue action against researchers who follow responsible disclosure practice.

The content on this site is provided for general information about Malwise and the services we offer. It is not professional advice. You should not act, or refrain from acting, on the basis of website content alone. If you need advice on a specific cyber security matter affecting your organisation, please engage us under a written agreement, or seek advice from another qualified professional.

9. Limitation of liability
Nothing in these Terms limits or excludes our liability for:

- fraud or fraudulent misrepresentation;

Subject to the paragraph above, and to the fullest extent permitted by law:

- we will not be liable for any loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect, consequential, or special loss, however arising, in connection with your use of, or inability to use, this site;

If you engage us to deliver services under a written agreement, the liability provisions in that agreement will govern that engagement and will supersede this clause in respect of the services.
10. Indemnity
You agree to indemnify Malwise Cyber Ltd against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the site, or any unauthorised activity carried out by you against our infrastructure.
11. Engagement of services
For clarity:
- nothing on this website constitutes an offer to provide services on any specific terms;
- requesting a scoping call, submitting an enquiry, or receiving a quotation does not create a contract between you and Malwise;
- engagements only begin when both parties have signed a written engagement letter or statement of work, and any pre-engagement discussions are subject to that signed agreement;
- as a licensed Cyber Essentials Certification Body, our certification activities are also subject to the rules of the IASME consortium, in addition to our own engagement terms.
12. Suspension and termination of access
We reserve the right to refuse, restrict, or terminate your access to this site at any time, without notice, if we believe in good faith that you have breached these Terms, that your activity poses a risk to us or to other users, or that continued access is otherwise inappropriate.
13. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be deemed severed and the remaining provisions will continue in full force and effect.
14. Entire agreement
These Terms, together with our Privacy Notice and (where applicable) any signed engagement agreement, constitute the entire agreement between you and Malwise Cyber Ltd in respect of your use of this site. They supersede any prior or contemporaneous communications, whether written or oral, on the same subject matter.
15. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or your use of this site, are governed by the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales, except that we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.
